Reech AI, Reech – Ads Connector & WhatsApp AI Agents

Last updated: October 16, 2026

These Terms of Service govern access to and use of the Reech AI platform, including the Reech – Ads Connector application and the WhatsApp AI agents available at https://agents.reechai.cloud. Please read them carefully: by using the service you agree to be bound by them.

1. Acceptance

By creating an account, connecting a Meta or WhatsApp Business account, or otherwise using the service, the business customer ("Customer") accepts these Terms and the Privacy Policy (https://reechai.com/en/privacidad). Anyone accepting on behalf of a business represents that they have authority to bind it. If you do not agree, do not use the service.

2. Service Description

Reech AI ("Reech") provides a software platform that includes:

  • Reech – Ads Connector: connection and synchronization of advertising data from Meta platforms for analysis, reporting and optimization.
  • WhatsApp AI agents: the Customer connects its own WhatsApp Business Account through Meta Embedded Signup; Reech receives and sends messages on its behalf through the official WhatsApp Business Cloud API, an AI model answers its customers, and Reech manages its message templates.
  • An admin dashboard to configure agents, review conversations and view metrics.

3. Eligibility and Account

The service is intended exclusively for businesses and professionals, not consumers. The Customer must be of legal age, have legal capacity to contract, hold valid Meta Business and WhatsApp Business accounts, and provide accurate information. The Customer is responsible for keeping its credentials confidential and for all activity carried out from its account.

4. Customer Responsibilities

  • Comply with the WhatsApp Business Messaging Policy, the WhatsApp Commerce Policy, the WhatsApp Business Terms of Service, the Meta Platform Terms and applicable law.
  • Obtain and document opt-in consent from its end customers before messaging them on WhatsApp, and promptly honor opt-out requests.
  • Inform its end customers that they may be served by an AI assistant and provide a way to reach a human when appropriate.
  • Act as the data controller for its end customers' data and have a legal basis to process it.
  • Review and approve its message template content and the product, pricing and policy information it provides to the agent, and keep it up to date.
  • Keep its WhatsApp Business Account, phone number and Meta payment method active and in good standing.

5. Fees and Billing

WhatsApp conversations and messages are billed directly by Meta to the Customer, who must add its own payment method to its WhatsApp Business Account; Reech does not charge or intermediate those fees. Fees for using the Reech platform, where applicable, are governed by the commercial proposal or agreement signed with the Customer.

6. Acceptable Use

The Customer may not use the service to:

  • Send spam, unsolicited messages, or messages to people who have not given consent.
  • Offer or promote products or services prohibited by the WhatsApp Commerce Policy or by law.
  • Distribute illegal, misleading, fraudulent, defamatory, discriminatory or violent content, or content that infringes third-party rights.
  • Impersonate another person or business, or collect sensitive data (for example, full payment card numbers, passwords or health data) through the agent without an adequate legal basis.
  • Attempt unauthorized access to systems, accounts or data, interfere with the operation of the service, or reverse engineer the platform.
  • Resell or sublicense the service without Reech's written authorization.

7. Third-Party Services

The service relies on third-party platforms, in particular Meta Platforms, Inc. and WhatsApp LLC (WhatsApp Business Cloud API and Marketing API), as well as infrastructure and AI providers. Use of those platforms is also governed by their own terms and policies. Reech does not control those platforms and is not responsible for their outages, pricing or policy changes, account restrictions, template rejections, messaging limits, or decisions Meta makes regarding the Customer's account.

8. AI-Generated Responses

The agent's replies are generated automatically by artificial intelligence models based on the information and configuration provided by the Customer. While we work to make them accurate, they may contain errors, omissions or outdated information. The Customer is responsible for configuring and supervising its agent, verifying the information it communicates (prices, stock, delivery times, terms) and for any offers or commitments made on its behalf. Agent replies do not constitute legal, medical, financial or professional advice.

9. Data Protection

For end-customer data processed through WhatsApp, the Customer is the data controller and Reech acts as data processor, processing it solely to provide the service and according to the Customer's instructions, with the subprocessors and retention periods described in the Privacy Policy (https://reechai.com/en/privacidad). Reech does not use this data for advertising or to train general-purpose AI models.

10. Intellectual Property

Reech retains all rights to the platform, its software, design and trademarks. The Customer retains all rights to its content, data, trademarks and WhatsApp Business Account, and grants Reech a limited license to use them solely to provide the service.

11. Suspension, Termination and Disconnection

The Customer may stop using the service at any time by removing the "Reech – Ads Connector" integration from Business Settings > Integrations in Meta Business Suite or by writing to privacy@reechai.com. Reech may suspend or terminate access, with or without prior notice, if the Customer breaches these Terms or Meta or WhatsApp policies, if Meta requires it, or if the use poses a risk to the security of the service or third parties. After disconnection, the access token is deleted immediately and other data is deleted according to the Privacy Policy and the instructions at https://reechai.com/en/eliminacion-datos.

12. Limitation of Liability

The service is provided "as is" and "as available". To the maximum extent permitted by law, Reech shall not be liable for indirect, incidental, special or consequential damages, lost profits, loss of data or business opportunities, failures of third-party services (including Meta and WhatsApp), or AI-generated replies. Reech's total liability for any claim related to the service is limited to the amount paid by the Customer to Reech during the twelve (12) months preceding the event giving rise to the claim.

13. Changes to These Terms

Reech may modify these Terms at any time. Changes will be posted on this page with a new update date and, if material, notified to Customers. Continued use of the service after posting constitutes acceptance of the modified Terms.

14. Governing Law and Jurisdiction

These Terms are governed by the laws of the Republic of Peru. Any dispute shall be submitted to the judges and courts of the city of Lima, Peru, unless applicable law provides otherwise.
